Antony Sahaya Prabahar Additional Public Prosecutor PRAYER :- To enlarge the petitioner on bail in the event of their arrest in connection with C.C.No.128 of 2016 in Crime no.1118 of 2015 for the alleged offences under section 8(c) r/w 20(ii)(B) of NDPS Act on the file of learned Special Court for Communal Clash Cases, Madurai. ORDER : The Court made the following order :- 1/4

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w. 20(II)(B) of NDPS Act, in Crime No.1118 of 2015 in C.C.No.128 of 2016 on the file of the Special Court for Communal Clash Cases, Madurai seeks anticipatory bail.

2.The learned counsel appearing for the petitioner submitted that due to unavoidable circumstances, the petitioner was unable to appear before the trial Court, hence, the trial Court has issued an NBW against the petitioner on 08.05.2023. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks to grant anticipatory bail to the petitioner.

3.The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the offence committed by the petitioner is serious in nature.

4. Considering the facts and circumstances of the case, this Court is directing the petitioner to surrender before the trial Court and submit a bail application before the trial Court. On such submission, the learned trial Judge, shall consider the bail application in accordance with law on merits on the same date.

5.With the above said direction, this Criminal Original Petition is disposed of.
