ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 IPC r/w Section 21(1) of Mines and Minerals (Development and Regulation) Act in Crime No.124 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with the other accused have illegally transported 1⁄4 unit of river sand. Hence, the case.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent and a false case has been registered against him. Hence, he seeks for anticipatory bail. https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.502 of 2023 4.The learned Government Advocate (Crl. Side) appearing for the respondent would submit that the petitioner is a habitual offender and he has involved in illegal transportation of river sand and he has got three previous cases of similar in nature. Hence, he vehemently opposed to grant anticipatory bail. 5.Heard. Perused the materials available on record including the First Information Report.

6.Taking into consideration the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
