PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the third respondent to recommend the petitioner's village to the first and second respondents to include in the Gazatte Notification and permit the petitioner to conduct Vadamadu Manjuvirattu Program on 18.01.2024 as part of Pongal Festival at Paganeri Village, Sivagangai District based on G.O.Ms.No.7, Animal Husbandry Dairying and Fisheries (AH3) Department, dated 21.01.2017 by considering the representation dated 04.01.2024.

[Order of the Court was made by D.KRISHNAKUMAR, J.] This Writ Petition is filed seeking issuance of a Writ of Mandamus, directing the third respondent to recommend the petitioner's village to the first and second respondents to be included in the Gazatte Notification and permit the petitioner to conduct Vadamadu Manjuvirattu Program on 18.01.2024 as part of Pongal Festival at Paganeri Village, Sivagangai District based on G.O.Ms.No.7, Animal Husbandry Dairying and Fisheries (AH3) Department, dated 21.01.2017 by considering the representation of the petitioner dated 04.01.2024. 2/ 6

2.By consent of both parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3.According to the petitioner, he made a representation dated 04.01.2024 to the respondents 3 to 5, seeking to recommend the first and second respondents to include the name of the petitioner's village in the Gazatte Notification and permit the petitioner to conduct Vadamadu Manjuvirattu Program on 18.01.2024 as part of Pongal Festival. Since the same has not been considered till date, the petitioner has approached this Court with the aforesaid prayer.

4.Mr.P.Thilakkumar, learned Government Pleader, who takes notice on behalf of the respondents 1 to 3, on instructions, submits that though the petitioner's village was included in the Tamil Nadu Government Gazette Notification till 2018, in the subsequent years, the petitioner's village was not included in the gazette notification. He further submits that necessary steps would be taken by the respondents to consider the request of the petitioner on merits, if the petitioner is found eligible, and appropriate orders would be passed within a time frame.

5.Considering the aforesaid submissions on side, without going into the merits of the case, we are inclined to direct the third respondent to consider the representation of the petitioner dated 04.01.2024 and pass appropriate orders on its own merits and in accordance with law on or before 16.01.2024. 6.With the above direction, this Writ Petition stands disposed of. No costs.
