ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police in pursuance of the Non Bailable Warrant issued in C.C.No.75 of 2015 for the alleged offence punishable under Sections 406, 408, 464, 468 and 471 IPC on the file of the learned Judicial Magistrate, Nilakkottai, and hence, seeks anticipatory bail.

2.It is submitted by the learned counsel for the petitioner that initially the first accused alone has arrayed as accused. Based upon the confession statement of the first accused, the petitioners have been arrayed as accused.

3. The learned Government Advocate(Crl.side) appearing for the State submitted that final report has been filed and the same was taken on file in C.C.No.75 of 2015 and the petitioners have been arrayed as accused. 4.Considering the facts and circumstances of the case, this Court is inclined to permit the petitioner to surrender before the concerned court and seek recalling of Non Bailable Warrant issued against him in C.C.No.75 of 2015 and on such surrender, the learned Magistrate is directed to consider the petition filed by the petitioners and pass orders on the same day on merits. sd/- 23/06/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
