Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police in pursuance of the Non Bailable Warrant issued by the learned Judicial Magistrate, Kumbakonam, on 27.01.2015 against him in connection with a case in P.R.C.No.19 of 2013 for the alleged offence punishable under Sections 147, 148, 294(b), 324, 307 and 302 I.P.C in Crime No.15 of 2013 on the file of the respondent police and hence, seeks anticipatory bail. 2.

It is submitted by the learned counsel for the petitioner that during investigation the petitioner was arrested and released on bail and subsequently, the respondent police laid charge sheet which was taken on file in P.R.C.No.19 of 2013. It is further submitted that the petitioner was regularly appearing and only due to ill-health, he could not appear before the committal court on 27.01.2015. The learned counsel further submitted that the petitioner undertakes to appear for all future hearings.

3.Heard the learned Government Advocate(Crl.side) appearing for the State, who would submit that totally five accused in this case and except this petitioner, the other accused are appearing before the learned Judicial Magistrate.

4.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Kumbakonam, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the said court on all hearings without fail. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
