ORDER

This writ petition is filed for a mandamus, to direct the respondents 1 and 2 to take action against the third respondent based on the petitioner's representation dated 11.11.2019.

2. The grievance of the petitioner is that he has approached the third respondent seeking retirement benefits and at that time, the third respondent abused him by degrading his community. Hence, he sent a representation dated 11.11.2019 to the respondents 1 and 2 to take action against the third respondent. Since there was no https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.758 of 2020 action on the said representation, he has filed the present writ petition.

3. If any such occurrence had taken place as claimed by the petitioner, it is always open to him to file a police complaint before the concerned Police Station. But, in this case, the petitioner has not preferred any police complaint before the concerned Police Station, instead, he sent a representation to the respondents 1 and 2 to take action against the third respondent and thereafter, filed the present writ petition. Further, he has not filed any proof that he has preferred any police complaint for the alleged occurrence that had taken place in the office of the third respondent.

4. Without taking any recourse to the remedy available as per law, the petitioner has filed this writ petition by invoking the extra ordinary jurisdiction of this Court under Article 226 of the Constitution of India that too without any sufficient materials. Therefore, this Court is not inclined to entertain this writ petition. Accordingly, the writ petition is dismissed with cost of Rs.10,000/- (Rupees Ten Thousand only).
