ORDER : The Court Made the following order :- The petitioners, who are arrayed as A4, A5 and A8, apprehend arrest at the hands of the respondent police for the alleged offence punishable under Section 379 I.P.C in Crime No.44 of 2015 and hence, seek anticipatory bail.
2.Though the petitioners were granted anticipatory bail, who being the petitioner No.2 in Criminal O.P(MD)No.4185 of 2015, the present petition has been filed on the sole ground that the name of the petitioner was wrongly typed as Sevakumar instead of Selvam. The learned Counsel appearing for the petitioners submitted that the bail granted by this Court is also expired.
3.The learned Government Advocate (Crl. Side) appearing for the State is not in dispute the above said facts.
4. Considering the facts and circumstances of the case, I am inclined to enlarge the petitioners on anticipatory bail. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Devakottai, and on each of them executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction to the learned https://hcservices.ecourts.gov.in/hcservices/
Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m until further orders. Further condition that, each petitioner shall deposit Rs.15,000/-(Rupees fifteen thousand only) without prejudice to their rights to the credit of Crime No. 44 of 2015 within a period of two weeks from the date on which the order copy made ready. The learned Judicial Magistrate, Devakkottai, shall invest the amount in any one of the nationalised banks till the disposal of the criminal case. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
5. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready failing which, the petition for anticipatory bail stands dismissed.
