ORDER

Seeking to set aside the return docket order dated 02.12.2025, passed by the Learned Special Court for TNPID Cases, Madurai in Unnumbered Crl.M.P.No.Nil of 2025, this criminal original petition is filed.

2. The learned counsel for the petitioner submitted that the petitioner was deceived in a chit scheme by the respondents 1 and 2, for which he had filed a petition under Section 175(3) of BNSS, 2023 before the learned Special Court for TNPID Cases, Madurai. However, for not complying with the procedures under Section 175(4) of BNSS, the learned Special Court had returned the same. Seeking to set aside the same, this criminal original petition is filed.

3. The learned Additional Public Prosecutor submitted that one of the similarly placed depositor has already filed a writ petition before this Court and by the order of this Court, the Inspector of Police, Economic Offences Wing - II, Karur was directed to consider the 2/5

representation of the petitioner therein. In view of the same, the petitioner herein may be directed to submit his complaint before the Economic Offences Wing, Karur and they will take a final call.

4. Heard the learned counsel on either side and perused the materials available on record.

5. In view of the submission made by the learned Additional Public Prosecutor, the petitioner is directed to make a fresh complaint to the Economic Offences Wing, Karur. On receipt of the same, the Investigating Officer of Economic Offences Wing, Karur is directed to to set the criminal law in motion.

6. With the above directions, this Criminal Original Petition stands disposed of.
