ORDER

Heard Mr. C.Ramanathan, Learned Counsel for the Petitioners and Mr. P.Subbaraj, Learned Additional Government Pleader for the Respondents and perused the materials placed on record, apart from the pleadings of the parties.

The Writ Petition has been filed challenging the proceedings of the Joint Commissioner / Executive Officer, Kanyakumari District Thirukoilkal, Suchindram, 2nd Respondent herein in R.No.2926/12/D3 dated 16.08.2012 seeking to re recover the rented dues from the Petitioner as arrears of land revenue.

Learned Counsel appearing for the Petitioners states that a sum of Rs.1,42,147/- as demanded in the impugned notice has been paid on 02.01.2023 and he has filed a memo to that effect, which reads as follows:- "As per the undertaking given by the petitioner dated 2/4

15.12.2022, the petitioner has complied with the undertaking given before this Hon'ble Court by paying the balance arrear amount of Rs.1,42,147/- on 02.01.2023 by Demand Draft in the name of the 2nd respondent, issued by Indian Overseas Bank, Thazhakudy, vide D.D.No. 465633. In the proof of the same a copy of the Demand Draft is enclosed with.

Hence, The direction of this Hon'ble Court has been complied with."

In such circumstances, nothing remains for further consideration in the Writ Petition, but it would not preclude either of the parties, if they have any other grievance, from working out their remedies before proper forum in the manner recognized by law.

In fine, the Writ Petition is disposed with the aforesaid observations. Consequently, the connected Miscellaneous Petition is closed. No costs. 11.01.2023 NCC : Yes/No Index : Yes/No Sm Note: Issue order copy by 30.01.2023.
