ORDER : The Court Made the following order :- The petitioners who are arrayed as the first and second accused in C.C.No.295 of 2000 on the file of the Judicial Magistrate, Valliyoor, Tiurnelveli District apprehend arrest at the hands of the respondent police in pursuance of Non Bailable Warrant issued on 13.06.2013 for the alleged offence punishable under Sections 341, 323 and 506(i) I.P.C and hence, seek anticipatory bail.
2. The learned counsel for the petitioners submitted that the petitioners are not aware of filing of charge sheet in this case and without issuing summons, the learned Magistrate issued Non Bailable Warrant. The learned counsel further submitted that the petitioners are ready to appear before the trial court and to co-operate with the disposal of the case.
3.The learned Government Advocate(Crl.side) submitted that already 6 witnesses were examined and the petitioners have failed to appear before the trial court on 13.06.2013. 4.Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Crl. Side) appearing for the State and also perused the entire materials available on record.
5. Considering the facts and circumstances of the case, I am inclined to enlarge the petitioners on anticipatory bail. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Valliyur, https://hcservices.ecourts.gov.in/hcservices/
and on each of them executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two common sureties for a like sum to the satisfaction to the learned Magistrate concerned and on further condition that the petitioners shall appear before the trial on all future hearings without fail. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
6.
