PRAYER: Appeal filed under Section 19(1) of the Family Courts Act, to set aside the judgment and decree made in HMOP No.422 of 2020 by the Family Court, Thoothukudi dated 30.09.2022. For Appellant : Mr.D.Venkatesh For Respondent : Mr.N.Dilip Kumar C O M M O N JUDGMENT [Judgment of the Court was made by G.K. ILANTHIRAIYAN, J.] CMA(MD) No.62 of 2023 has been filed as against the judgment and decree passed in HMOP No.421 of 2020 by the Family Court, Thoothukudi dated 30.09.2022., thereby allowing the petition filed by the respondent/wife for restitution of conjugal rights as against the petitioner/husband.

2. CMA(MD) No.63 of 2023 has been filed as against the judgment and decree passed in HMOP No.422 of 2020 by the Family Court, Thoothukudi dated 30.09.2022., thereby dismissing the petition filed by the appellant/husband for divorce as against the respondent/wife.

3. The learned counsel appearing on either side expressed their willingness to settle the issue, therefore this Court referred the matter to the Mediation and Conciliation Centre attached to this Bench.

4. Before mediation both the parties appeared and settle the issue amicably by entering into settlement agreement dated 27.01.2026.

5. Pending these appeals the appellant and the respondent settled their issues amicably and to that extent they have also entered into settlement agreement dated 27.01.2026. Recording the above, these Civil Miscellaneous Appeals stand disposed of in terms settlement agreement dated 27.01.2026, executed between the parties. The settlement agreement dated 27.01.2026 shall form part of the judgment. No cost.
