Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.PRAKASH R, Advocate for the petitioner and of MRS.M.ASHA, GOVERNMENT ADVOCATE on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition imposed by this Court in Crl.M.P.(MD)No.3253 of 2021 in Crl.A.(MD)No.200 of 2021 dated 26.07.2021.
2.On the side of the petitioner, it is stated that this Court has granted suspension of sentence to the petitioner vide order dated 26.07.2021 and directed the petitioner to appear before the concerned Court daily twice at 10.30 a.m., and 05.00 p.m. The petitioner is complying the condition till now and prayed the condition to be relaxed.
3.On the side of the prosecution, it is stated that the petitioner is not complying the condition regularly and he was absent on 16.08.2021, 18.09.2021, 20.10.2021, 22.10.2021, 23.10.2021, 30.10.2021, 02.11.2021, 04.11.2021 to 07.11.2021, 09.11.2021, 11.11.2021, 13.11.2021, 16.11.2021 and from 02.12.2021 https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.665 of 2022 till date.
4.In view of the submission made by the learned Government Advocate (Crl. Side), this Court is not inclined to relax the condition imposed by this Court in Crl.M.P.(MD)No.3253 of 2021 in Crl.A.(MD)No.200 of 2021 dated 26.07.2021. Hence, this Criminal Miscellaneous Petition is dismissed.
