The petitioner is the sole accused in SC.No.57 of 2019, on the file of the Mahila Court, Pudukkottai. He was tried for the offence under Sections 392 r/w 397 and 506(ii) IPC that he has snatched away the Thali chain of the defacto complainant at knife point and also criminally intimidated her. The trial Court has found the petitioner guilty, convicted and sentenced as under:- Sl.No Sections Punishment Fine amount Default 1.

506(i) IPC 2 years Rigorous imprisonment - - As against the conviction and sentence imposed by the trial Court in SC.No.57 of 2019, dated 22.03.2021, the petitioner has filed a Criminal Appeal in Crl.A(MD) No.414 of 2021 and the same was admitted by this Court, by order, dated 06.10.2021. The earlier 2/5
application filed by this petitioner in Crl.MP(MD) No.13547 of 2024 for suspension of sentence was dismissed by this Court, by order, dated 17.02.2025, considering the nature of offence and the bad antecedents of this petitioner. This is the second application, seeking suspension of sentence.
2.The learned Government Advocate (Crl.side) has raised strong objection that apart from this case, the petitioner has also involved 24 other cases, out of which, 15 cases are disposed of and 9 cases are still pending. Therefore, if the petitioner is released on bail, he may indulge in further offence.
3.Considering the objections of the learned Government Advocate(Crl.side), the earlier order of this Court and the petitioner's bad antecedents, this Court is not inclined to suspend the sentence imposed on this petitioner. Accordingly, this Criminal Miscellaneous Petition is dismissed. It is reported that the typed set of papers are 3/5
made ready. Since the petitioner is denied for suspension of sentence, Registry is directed to list the Criminal Appeal under the caption ''accused in jail cases''.
