Criminal Original Petition is filed under Section 482 of Cr.P.C., to call for the records and to quash the C.C.No.256 of 2007 on the file of Judicial Magistrate Court No.II, Ramanathapuram in respect of Crime No.36 of 2005 on the file of the first respondent police insofar as the petitioner is concerned.

O R D E R

This Criminal Original Petition is filed to call for the records and to quash the C.C.No.256 of 2007 on the file of Judicial Magistrate Court No.II, Ramanathapuram in respect of Crime No.36 of 2005 on the file of the first respondent police insofar as the petitioner is concerned.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side).

3. Taking note of the fact that the case is pending from 2007 onwards on the file of learned Judicial Magistrate No.II, Ramanathapuram in respect of Crime No.36 of 2005, this Court is of the view that it would suffice a direction is given to dispose of the case in C.C.No.256 of 2007. Accordingly, the learned Judicial Magistrate No.II, Ramanathapuram is directed to dispose of the case in C.C.No.256 of 2007 within a period of four months from the date of receipt of a copy of this order. The personal appearance of the petitioner before the trial Court is dispensed with, unless and until it is specifically required by the said Court. With the above direction, this Criminal Original Petition is disposed of.
