as of lodging at Special Camp, Cheyyar and alter the same that the petitioner shall be released on bail without being lodged at any.. ORDER : The Court Made the following order :- The present modification petition has been filed to modify the condition in para No.5 imposed by this Court in Crl.O.P(MD).No.9391 of 2025 dated 20.06.2025.

2. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that a special Government Order in G.O. (1D) No. 131 dated 24.02.2025 was passed, wherein the petitioner was directed to stay at the Special Camp, Cheyyar. Once the Government Order is passed, the same cannot be changed or modified unless it is challenged in accordance with law.

3. Considering the above submissions, the present petition cannot be entertained. However, liberty is granted to the petitioner to challenge the said Government Order in the manner known to law. 2/5

4. The learned counsel for the petitioner submitted that the final report in Crime No. 1 of 2019 was taken on file in C.C. No. 1503 of 2022 and the same is pending before the learned Judicial Magistrate No. IV, Madurai. The said post is still vacant and therefore, the trial has not commenced so far. Hence, prayed to issue a direction to transfer the case to some other Court.

5. This Court, by order dated 13.01.2026, sought a status report from the concerned Judicial Magistrate. A report dated 30.01.2026 was received from the Chief Judicial Magistrate, Madurai, wherein it is stated that the post of Judicial Magistrate No. IV, Madurai, is vacant and therefore, C.C. No. 1503 of 2022 may be transferred to the file of the Judicial Magistrate Nos. I, II, or V, Madurai, for trial.

6. In view of the above, the learned Chief Judicial Magistrate, Madurai, is directed to transfer C.C. No. 1503 of 2022 to the file of the learned Judicial Magistrate No. II, Madurai. Since the petitioner has requested a speedy trial, the learned Judicial Magistrate No. II, Madurai, is directed to expedite the trial and dispose of the case as expeditiously as possible.

7. With the above directions, this Criminal Miscellaneous petition is disposed of .
