PRAYER: Writ Petition filed under Article 226 of the constitution of India, to issue a Writ of Certiorari, to call for the records of 3rd respondent in Ref. ORDER

When it is pointed out by the Learned Government Advocate for the Respondents that the Petitioner has got an effective alternative remedy under Section 47 - A(10) of the Stamp Act, 1899, to file an https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.3768 of 2011 appeal in this Court, the Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to resort to the same and he has made an endorsement to that effect, which is recorded.

Accordingly, the Writ Petition is dismissed as withdrawn granting such liberty. It is also made clear that for computing limitation for filing such appeal, the period from the date of presentation of this Writ Petition i.e., 23.03.2013 till the date on which certified copy of this order is made ready by the Registry, shall be excluded. Consequently, connected Miscellaneous Petition is closed. No costs.
