O R D E R

This Criminal Original Petition has been filed seeking to quash the FIR in Crime No.499 of 2024 on the file of the first respondent police, registered against the petitioners for the offences punishable under Sections 296(b), 115(2), 118(1) and 351(3) of the Bharatiya Nyaya Sanhita (BNS), 2023.

2. The allegation in the FIR is that on account of prior enmity, the petitioners attacked the second respondent/defacto complainant with bear bottles and hands, causing injuries, abused him in filthy language, and committed the criminal intimation, and thus committed the aforesaid offences.

3. Admittedly, the petitioners and the second respondent/defacto complainant belong to the same village. The parties have now entered into Page No. 2 of 5

a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 17th December 2024.

The petitioners, namely, (1) P.George [Aadhaar No.8863 2635 5195], (2) Naresh @ Maria Antony Naresh [Aadhaar No.9078 9060 2525], (3) Sibi @ Maria Sibi Vijay [Aadhaar No.4116 6252 5271] and (4) Kumarasethuram [Aadhaar No.4540 4060 3580], and the second respondent/defacto complainant, namely, T.Proses [Aadhaar No.7264 9997 0378] are present before this Court in person. The parties are identified by Mr.Deivamani, Special Sub-Inspector of Police, North Police Station, Thoothukudi District. The second respondent/defacto complainant confirmed the compromise arrived at between the parties and stated that he does not wish to pursue the case.

5. Considering the compromise and the nature of the offences, this Court is of the view that no useful purpose would be served by keeping the First Information Report (FIR) pending investigation. Accordingly, the impugned First Information Report (FIR) in Crime No.499 of 2024 on the file of the first respondent police, is quashed. The petitioners shall pay a sum of Rs.10,000/- (Rupees Ten Thousand only) to the Siddha Page No. 3 of 5

Unit attached to this Court (A/c. No.10767823177, IFSC Code : SBIN0000898 & MICR Code : 625002601) forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry. The compromise memo filed by the parties shall form part and parcel of this order.
