To extend the time mentioned in Crl MP(MD) No.15338/2025 in Crl RC (MD) No.1374/2025 dt.23.10.2025 further 10 more days and thus render justice.

ORDER

The present Criminal Miscellaneous petition is filed seeking extension of time in complying the orders of this Court passed in Crl.MP. (MD).No.15338 of 2025 in Crl.RC(MD).No.1374 of 2025 dated 23.10.2025.

2. Learned counsel for the petitioner submitted that this Court, by order dated 23.10.2025, had granted suspension of sentence subject to the following conditions :

''(i) The Revision petitioner shall surrender before the Learned District Sessions Judge (Fast Track), Nagercoil, Kanyakumari District within three weeks from today and on such surrender, the revision petitioner is ordered to be released on bail on his executing a personal bond along with two sureties for a sum of Rs.10,000/- each subject to furnishing undertaking that he will co-operate in the hearing of the present Revision. (ii) The Revision petitioner and sureties shall affix their photographs and Left Thumb Impression in the bond and the above said Court may obtain a copy of their Aadhaar card or Bank pass Book to ensure their identity; and; (iii) The realization of fine, if any, shall also remain suspended during the pendency of the present Revision. (iv) The Revision Petitioner shall appear before the learned District Sessions Judge (Fast Track), Nagercoil, Kanyakumari District, once in every month, ie., on the first working day, commencing from the month of November 2025, at 10.30 a.m., until further orders.''

3. It is further submitted that the said order was obtained by the erstwhile counsel on 23.10.2025, but not communicated to the petitioner. Petitioner was thus unable to comply with the said order in terms of the directions of this Court. In such circumstances, the learned Counsel for the petitioner would submit that the petitioner may be granted ten days time to surrender and comply with the condition No.9(i).

4. Mr.P.Kottaisamy, learned Government Advocate (crl.side) appearing for respondent, stated that he has no objection in allowing this petition.

5. In view thereof, the petitioner shall surrender before the Learned District Sessions Judge (Fast Track), Nagercoil, Kanyakumari District within ten days from today and on such surrender, the revision petitioner is ordered to be released on bail on his executing a personal bond along with two sureties for a sum of Rs.10,000/- each subject to furnishing undertaking that he will co-operate in the hearing of the present Revision. The Revision Petitioner shall appear before the learned

District Sessions Judge (Fast Track), Nagercoil, Kanyakumari District, once in every month, ie., on the first working day, commencing from the month of February 2026, at 10.30 a.m., until further orders.
