BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 18.01.2024

CORAM:

THE HONOURABLE Mrs. JUSTICE R. HEMALATHA P.Malaiyappan ... Petitioner Vs.

1.The Superintendent of Police, Office of the Superintendent of Police, Virudhunagar District, Virudhunagar.

2.The Sub Inspector of Police, South Police Station, Rajapalayam, Virudhunagar District.

3.Charles, The Sub Inspector of Police, South Police Station, Rajapalayam, Virudhunagar District.

...Respondents

PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, direct the respondents to issue a non traceable certificate for the original sale deeds of the petitioner, which were missed by him, based on the complaint given by the petitioner dated 05.12.2023. 1/4

For Petitioner : Mr.K.Muthu Ganesa Pandian For Respondents : Mr.T.Senthil Kumar Additional Public Prosecutor

ORDER

The grievance of the petitioner is that though the petitioner lost his documents and also followed all the procedures prescribed in the circular issued by the Director General of Police in Rc.No.2029209/General.1 (1)/2022 dated 01.04.2022, the Police had not issued the 'non traceable certificate' to the petitioner. His further contention is that he wanted to execute a gift deed in favour of his daughter and that after filing of the present Writ Petition, the respondents have sent a communication stating that the complaint given by him is found to be false and therefore they closed the same.

2. The learned Additional Public Prosecutor on instructions would contend that the Police after conducting proper enquiry had closed the petitioner's representation dated 05.12.2023 and therefore he has to approach the proper forum.

3. Recording the said submission, the present Writ Petition is disposed of with a liberty to the petitioner to challenge the final orders passed by the respondent Police or approach proper forum, if so advised.
