ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 294(b), 323, 324 and 307 I.P.C in Crime No.157 of 2014 and hence, seeks anticipatory bail.
2.The case of the prosecution is that while irrigating the field a wordy quarrel arose between the de-facto complainant and the petitioner and the co-accused and thereby the de-facto complainant was attacked by the petitioner as also by the co-accused and threatened with dire consequences.
3.The learned counsel for the petitioner submitted that the name of the petitioner does not find place in the F.I.R. and she was included at the time of filing the charge sheet. He further submitted that the petitioner is an innocent person and she has been falsely implicated in this case.
4.The learned Government Advocate (Crl. Side) would submit that the respondent police has completed the investigation and the coaccused were granted anticipatory bail.
5. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the state.
6. Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Mudhukulathoor, and on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready failing which, the petition for anticipatory bail stands dismissed.
