Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, calling for the records to the allotment order issued by the respondent vide Ref.No.D1/SIC/NLK/SPLSPL/2011, dated 02.08.2012 and quash the same insofar as it fixes the amount payable per acre at Rs.14.50 Lakhs and consequently direct the respondent to fix the value for plot No.D1 in Industrial Complex, Nilakottai at Rs.6,00,000/- per acre.

This writ petition is filed to quash the allotment order issued by the respondent vide Ref.No.D1/SIC/NLK/SPLSPL/2011, dated 02.08.2012 and for a consequential direction to the respondent to fix the value of the plot No.D1 in Industrial Complex, Nilakottai at Rs.6,00,000/- per acre.

2.The learned counsel appearing for the petitioner submits that the petitioner is a Pharma Company, registered under the provisions of Indian Companies Act. In response to the information received through the Madurai Small Scale Industries Association, the petitioner applied for allotment of an industrial plot in the SIPCOT Industrial Complex, Nilakkottai on 11.11.2011. While attending an interview, on 07.12.2011, the cost of the plot was mentioned as Rs.6,00,000/- per acre. However, the petitioner was issued with the allotment order vide Ref.No.D1 / SIC/ NLK/ 2/5

SPLSPL/2011, dated 02.08.2012, fixing the amount payable per acre as Rs.14.50 Lakhs. Hence, the petitioner filed this writ petition. 3.Today(06.03.2023), when this writ petition is taken up for hearing, the learned counsel appearing for the petitioner submits that the petitioner died during COVID-19 pandemic and with his best efforts, he could not contact the legal heirs of the petitioner also. 4.In view of the difficulty expressed by the learned counsel for the petitioner that the petitioner died and he could not contact the legal heirs of the petitioner, this writ petition is dismissed as abated with a liberty to the petitioner's legal heirs, if anybody, to challenge the allotment order of the respondent, if they are advised so. No costs. Consequently, connected Miscellaneous Petition is closed.
