CRIME NO.396/2017 ... RESPONDENT/ COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to extend the time in Crl. MP(MD)No. 357/2018 in Crl.OP(MD)No. 17166/2017 dated 18.01.2018 to produce the sureties before the Learned Judicial Magistrate, Melur.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.MP AMALAN, Advocate for the petitioners and of M/S.K.SUYAMBULINGA BHARTHI, Govt.Advocate(Crl.Side) on behalf of the Respondent, the court made the following order:- This petition is filed to extend the time granted to the petitioners in Crl.M.P.(MD)No.357 of 2018 in Crl.O.P(MD)No.17166 of 2017, dated 18.01.2018.
2.This Court, by order dated 13.12.2017 made in Crl.O.P(MD) No.17166 of 2017, granted anticipatory bail to the petitioners and directed them to appear before the concerned Magistrate, within a period of 15 days from the date on which the order copy was made ready. However, the petitioners did not comply with conditions, within the time prescribed by this Court. Therefore, earlier they filed Crl.M.P.(MD)No.357 of 2018 in Crl.O.P.(MD)No.17166 of 2017, seeking extension of time. This Court, vide its order dated 18.01.2018, granted 10 days time to the petitioners i.e. till 28.01.2018 for executing the sureties. produce the same before the concerned Court. Hence, they have approached this Court with the present petition for extension of time.
3.The learned counsel appearing for the petitioners contended that the petitioners could not produce the sureties within the time prescribed by this Court and hence, he prays for extension of time. 4.Heard the learned Government Advocate (Crl. Side). 5.Considering the reasons stated in the affidavit filed in support of this petition, this petition is ordered and the time for executing the sureties is extended for a further period of two weeks from today.
