ORDER

The memorandum impugned in the writ petition is set aside only on the ground that the petitioner was not put on notice. The matter is remitted to the file of the first respondent. The first respondent will issue notice to the petitioner and pass final order on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. It is stated by the petitioner's counsel that a sum of Rs.50,000/- was already deposited to the credit of the writ petition. The petitioner is permitted to withdraw the same.

2. The Writ Petition is allowed on these terms. No costs. Consequently, connected miscellaneous petition is closed.
