PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 1st respondent to reissue petitioner passport No.M5554689 dated 19.01.2015 by considering petitioner's passport application No.TR6077351730125 within a stipulated time as may be fixed by this Court. 1/4

O R D E R

The present writ petition has been filed seeking mandamus as against the first respondent to reissue the passport of the petitioner based upon her application.

2. The learned Government Advocate (Crl.Side) appearing for the respondents 2 and 3 brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.6/2022 on the file of the third respondent. So far, investigation has not been completed. According to her, serious allegations have been made as against the writ petitioner and charge sheet is likely to be filed in the near future.

3. Considering the fact that in the past three years, the 2/4

investigation has not been completed and charge sheet has not been filed, this Court is inclined to pass the following orders: (a) The first respondent is directed to consider the application of the writ petitioner and pass orders in the passport application within four

(4) weeks from the date of receipt of a copy of this order. (b) In case charge sheet is taken on file by the concerned trial court, the third respondent is at liberty to address a communication to the first respondent for impounding the passport.

4. With the said observations, this Writ Petition is disposed of. No costs.
