O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to survey and measure the petitioner's property, comprised of land measuring 1 Acre in R.S.No. 60/2A2, Usilampatti Village, Usilampatti Taluk, Madurai South District, pursuant to the application dated 27.11.2025, within a reasonable time as may be fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner would submit that though an online application has been made for the survey of the property in question and for demarcation of its boundaries, the same has not been considered by the first respondent.

4. The learned Government Advocate appearing for the first respondent would submit that there is a civil dispute between the petitioner and the private respondents.

The learned counsel appearing for the petitioner would submit that the application was made after the petitioner was successful in the civil suit; that as on date, no appeal is pending; that however, it came to the knowledge of the petitioner that the appeal filed by the second to fifth respondents has not been numbered; and that therefore, till date, the petitioner continues to be the decree holder and the owner of the property.

This Court is of the view that since an application has been made along with the requisite fee, it is for the first respondent to consider and dispose of the same, taking into consideration the civil dispute. Therefore, this Court directs the first respondent to consider the petitioner's online application dated 27.11.2025, after taking into consideration the pending civil dispute and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. to state that before passing any order, the petitioner and the private respondents shall be given an adequate opportunity of hearing.

7. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
