ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 8(c), 20(b)(ii)9(B) of NDPS Act of I.P.C., in Crime No. 166 of 2024 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused was found in illegal possession of 1.200 kilograms of ganja. Hence, the complaint.
3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for the respondent Police submits that the petitioner has jumped bail. He further submits that one previous case is pending against the petitioner. 2/4
5. Considering the fact that the petitioner has jumped bail, this Court is directing the petitioner to surrender before the District and Sessions Court for EC and NDPS Act Cases, Madurai and file a recall application. On such application, the concerned Court shall consider the same in accordance with law on merits on the same day.
6. With the above said directions, this Criminal Original Petition is disposed of.
