ORDER : The Court Made the following order :- The petitioner who is the sole accused, apprehends arrest in pursuance of the non-bailable warrant issued by the learned Judicial Magistrate, Mannarkudi in C.C.No.258 of 2009, for the alleged offence punishable under Section 138 of Negotiable Instrument Act, seeks anticipatory bail.

2. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl. side) appearing for the respondent.

3. The learned counsel for the petitioner submitted that due to viral fever, the petitioner has not appeared before the trial Court on 24.03.2014. He further submitted that the petitioner undertakes to appear before the trial Court for all future dates without bail.

4. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned *Judicial Magistrate-II, Mannarkudi and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the trial Court in connection with case in C.C.No.258 of 2009, for all future hearings without fail. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. *Time is extended by two weeks, for executing sureties, from the date on which the order copy made ready.
