(MD) NO. 13559/2017 in S.C No. 260/2017 on the file of the Principal Sessions Judge, Kanyakumari district at Nagercoil dated 30.10.2017 and pass any other orders which this Honourable Court deem fit and proper in the circumstances of the case.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.B.N.RAJA MOHAMED, Advocate for the petitioner and of Mr.K.SUYAMBULINGA BHARATHI Government Advocate (Criminal Side) on behalf of the Respondents the court made the following order:- This Petition has been filed to relax the condition imposed in Crl.O.P.(MD)No.13559 of 2017, dated 30.10.2017. 2.The learned counsel appearing for the petitioner submitted that the petitioner was not able to appear for both the cases at two different places viz., before the Principal Sessions Judge, Kanyakumari District at Nagercoil in S.C.No.260 of 2017 and learned Judicial Magistrate, Eraniel in S.C.No.301 of 2017. 3.The learned Government Advocate (Crl.Side) submitted that the petitioner is complying with the condition regularly in S.C.No.260 of 2017.
4.Considering the facts and circumstances of the case and also considering the submission made by the learned Government Advocate (Crl.Side) that vide order dated 30.10.2017 made in Crl.O.P (MD)No.13559 of 2017 is modified to the effect that the petitioner shall appear before the Principal Sessions Judge, Kanyakumari https://hcservices.ecourts.gov.in/hcservices/
