93 of 2018 : Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased To Suspend the Substantial portion of Sentence alone and enlarge the petitioners on bail in C.A.No.53 of 2015 dated 25.01.2018 on the file of I Additional District and Sessions Judge, confirming and some extent modifying the judgment in C.C.No.383 of 2008 dated 16.10.2015 on the file of the Judicial Magistrate No.I, Tuticorin in respect of this Petitioners pending disposal of this Criminal Revision.

Prayer in CRL MP(MD). 1174/ 2018 :

To exempt the petitioners from surrendering in pursuance of Judgment dated 25.01.2018 in C.A.No.53 of 2015 on the file of the Learned I Additional District and Sessions Judge, Thoothukudi and thus render justice.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.MUTHALRAJ, Advocate for the petitioners and of MRS.S.BHARATHY, Government Advocate (Crl.Side) for the Respondent while admitting the Crl.Rc the court made the following order:- It is seen that both Courts below have found sufficient materials to Convict and sentence the petitioners/Appellants herein. This is a case, the victime is a woman. In such circumstances this Court is of the view that this is not a fit case in which he exemption can be granted to the petitioners from surrendering. Accordingly, these petitions are dismissed and the petitioners are directed the surrender and thereafter file a fresh petition for suspension of sentence. The Trial Court is directed to issue committal warrant.
