ORDER
This writ petition is filed for issuance of Writ of Mandamus, directing the respondents to grant permission to conduct petitioner's church 99th year Annual Celebration from 09.01.2026 to 18.01.2026 with customary religious practices of installing light, illumination and sound system by considering the petitioner's representation dated 15.12.2025 within the time stipulated by this Court.
2. Heard Mr.M.R.Sreenivasan, learned counsel appearing for the petitioner and the learned Government Advocate (crl. Side) appearing for the respondents and perused the material documents available on record.
3. It is submitted that the Church consists of 500 families who reside within a 2 km radius of the Church, and there are 16 Anbiyans operating under the Church. It is further stated that various Hindu temples, such as Nagalmoodu Issaki Amman Temple and Kallupativilai Arulmigu Samundeeswari Temple, are situated around the Church area. The members of the Church live in peace and harmony with people of other religions, and there 2/6
are no law and order issues. The petitioner is now seeking permission to celebrate the 99th Annual Celebration, which is scheduled to take place from 09.01.2026 to 18.01.2026.
4. The specific averment in the writ petition is that the Church members, some of whom are elderly and sick, reside nearly 2 km away from the Church. Therefore, they wish to set up light and sound systems in the surrounding area for prayers. The petitioner further submits that there is no objection from any other religious community.
5. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that the petitioner's representation had not been received. However, an acknowledgment card was produced before this Court along with the typed set of papers. Therefore, the respondents cannot make such a statement. The respondent police also submitted that the use of sound systems cannot be permitted based on the order of the Hon'ble Supreme Court.
6. Taking all these factors into consideration, this Court is of the considered opinion that a 10-day period for the 99th-year celebration is too long. Therefore, permission is granted for the use of the light and sound system 3/6
for a single day only, between 5 P.M. and 7 P.M. The petitioner can choose the day. The sound system may be permitted for the said day within permissible decibel limit.
