Prayer :- Writ Petition filed under Article 226 of Constitution of India, praying this court to issue a Writ of Mandamus,directing the 1st and 2nd respondents to restore the water connection and to unlock the drainage connection in respect of the petitioner's commercial building in Property Tax Assessment No.115/062/900906 in survey No.87/5A-2,Door No.22-A,By-pass Road,Madurai City with immediate effect in the light of the remittance of tax upto 07/12/2023 by considering the E-mail communication dated 07.01.2024.
ORDER:- This Writ Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the
arguments of Mr.C.M.Arumugam, Advocate for the Petitioner and of Mr.S.Devasena,for the respondents 1 & 2, this Court made the following order: The learned counsel for the petitioner submitted that as per the order of this Court dated 12.01.2024 passed in this writ petition, the petitioner has paid the first instalment amount before 13.01.2024. Further, he submitted that since there was some issues in his family, the petitioner could not pay the second instalment of a sum of Rs.10,00,000/- before 10.02.2024 and hence, he seeks four weeks time to comply the order dated 12.01.2024.
2. Considering his request, the time is extended upto 29.02.2024. The petitioner is directed to make payment of the second instalment of Rs.10,00,000/- on or before 29.02.2024 without fail, failing which the authorities are at liberty to proceed further in the manner known to law.
Post the matter on 04.03.2024.
