Prayer : Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus directing the first to fourth respondents to survey and democrate the petitioner's land in Survey Nos. 139/10, 139/2C and 139/13 and Natham patta No.567 to an extent of 3 cents (1280 sq ft), situated at Thirupallaikudi Village, Rajasingamangalam Taluk, Ramanathapuram District and directing the fifth respondent to provide police protection at the time of surveying the said land if necessary.

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first to fourth respondents to survey and demarcate the petitioner's land in Survey Nos. 139/10, 139/2C and 139/13 and in Natham Patta No. 567, measuring an extent of 3 cents (1280 sq. ft.), situated at Thirupallaikudi Village, Rajasingamangalam Taluk, Ramanathapuram District, and further directing the fifth respondent to provide police protection at the time of surveying the said land, if necessary.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the petitioner would submit that an application dated 28.07.2025 was made before the first respondent seeking demarcation of the boundaries of the property in question; that on receipt of the same, though the first respondent issued notices dated 16.09.2025 and 24.09.2025 directing the petitioner to appear in person for enquiry, pursuant to which the petitioner appeared on 23.09.2025 and 10.10.2025 respectively, the first respondent has not taken any steps to survey the land; that therefore, the petitioner sent a representation dated 15.12.2025, which also did not evoke any response; and that consequently, the petitioner was constrained to file the present Writ Petition.
4. The learned Government Advocate appearing for the first to fourth respondents would submit that after consideration of the claims of the parties, proper steps would be taken to demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

Recording the aforesaid submissions, this Court directs the first to fourth respondents to consider the petitioner's application dated 28.07.2025 and the representation dated 15.12.2025, demarcate the petitioner's land after consideration of the claims of all parties and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of sixteen weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the Civil Court. It is needless to state that before surveying the land, notice shall be issued to the adjacent landowners and other interested parties, if any. If required, police assistance may be taken.
6. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
