ORDER

This Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus to quash the impugned order passed by the third respondent vide proceedings in Application No.2025/0103/28/575151, dated 22.12.2025, and consequently to direct the third respondent to issue separate patta in respect of Survey Nos. 344/2B1A1 (extent 0.18.36 hectares) and 387/5A4 (extent 0.32.50 hectares), situated at Korampallam Part II, Thoothukudi Taluk, Thoothukudi District, in favour of the petitioner, within a time frame to be fixed by this Hon'ble Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel appearing for the petitioner submits that the petitioner's father owned certain ancestral properties and also acquired additional properties from the income of the ancestral properties. Due to sudden illness, the petitioner's parents transferred the subject properties to the petitioner, and the patta in respect of the said properties stands in the name of the petitioner and other legal heirs. Accordingly, the petitioner applied for a separate patta for the said properties on 22.12.2025. However, the same was rejected by the third respondent without conducting any enquiry, and before passing the impugned order, no opportunity of hearing was granted to the petitioner.

The learned Government Advocate appearing for the respondents submits that no proper documents have been filed along with the representation to substantiate the claim made by the petitioner and therefore, her application was rejected. If the petitioner submits a fresh application along with all the relevant documents before the third respondent, the same will be considered on merits and in accordance with law.

5. At this juncture, the learned counsel for the petitioner submits that the petitioner will file a fresh application along with the relevant documents within a period of two weeks from the date of receipt of a copy of this order.

6. In the event of filing a fresh application along with the necessary documents within the aforesaid time limit, the same shall be considered and disposed of by the third respondent on merits and in accordance with law, after affording due opportunity to all the parties concerned, within a period six weeks thereafter.
