RESPONDENT / RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to condone the absence of the petitioner from 2.2.18 to till now in complying the condition of appearing before the respondent police daily at 10.30 a.m. for a period of 3 weeks imposed by this Honouable Court in Crl O.P.(MD)No.700 of 2018 on 17/01/2018 and thus render justice.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of MR.KARTHICK SUBRAMNANIAN, Advocate for the petitioner and of Mr.SUYAMBULINGA BHARATHI Govt. Advocate ( Crl. Side) on behalf of the Respondents the court made the following order:- This petition has been filed to modify the condition imposed in Crl.O.P.(MD)No.700 of 2018, dated 17.01.2018.
2. The learned Government Advocate (Criminal Side) appearing for the State submitted that the petitioner is abiding the condition up to 01.02.2018 only. Further he added that the investigation is not yet completed. He further submitted that he has no objection to allow this application.
3. Heard both sides. Documents perused. In the order passed by this Court dated 17.01.2018, in Crl.O.P.(MD).No.700 of 2018, the petitioner is directed to appear before the respondent police daily at 10.30 a.m., for a period of three weeks alone. But, the petitioner is complied with the condition up to 01.02.2018. Now, he is willing to abide the condition imposed by this Court. Thereby, considering the reasons stated by the petitioner in this application, this Court is inclined to allow this application. https://hcservices.ecourts.gov.in/hcservices/
Hence, the absence of the petitioner for complying the condition from 02.02.2018 is condoned. Accordingly, this Criminal Miscellaneous Petition is ordered.
