Murugesan : Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 1 and 2 to include the name of the petitioner and the name of her children namely, Pavitra and Santosh Kumar in the Family Card and consequently to initiate necessary action against the third and fourth respondents for deleting their names.

ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the first and second respondents to include the name of the petitioner and her children in the Family Card.

2. According to the petitioner, the fourth respondent is her husband and he has unilaterally removed the name of the petitioner and her children in the Family Card. Therefore, representations were made before the first and second respondents to include the name of the petitioner and her children. Since the same was not considered, the present Writ Petition has been filed before this Court.

3. The learned counsel appearing on behalf of the petitioner submitted that as a subsequent development, a separate Family Card has been issued in the name of the petitioner and her children.

The learned counsel appearing on behalf of the fourth respondent submitted that the marriage between the petitioner and the fourth respondent was dissolved by Judgment passed in H.M.O.P.No.211 of 2008, dated 03.02.2009. The learned counsel further submitted that subsequent to the Judgment, there is no husband and wife relationship between the petitioner and the fourth respondent.

5. In the considered view of the Court, the relationship between the petitioner and the fourth respondent got snapped after the marriage was dissolved by the competent Court. Therefore, there is no requirement for the fourth respondent to add the name of the petitioner in the Family Card. That apart, the petitioner has already got a Family Card in her name.
