RESPONDENT/RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to modify the conditions imposed in Crl.O.P.(MD)No.808 of 2018, dated 30.01.2018 on the file of this Honourable Court and thus render justice.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.T.SASIDHARAN TAMILKANI, Advocate for the petitioner and of MR.K.SUYAMBULINGA BHARATHI, Government Advocate (Crl.side) on behalf of the Respondent and of MR.M.JEGADEESH PANDIAN, Advocate for the Intervener the court made the following order:- This petition has been filed to modify the condition imposed in Crl.O.P.(MD)No.808 of 2018, dated 30.01.2018.
2. The learned counsel appearing for the petitioner submitted that the petitioner is ailing from heart disease. Hence, he seeks for relaxation of the condition imposed by this Court. 3.The learned Government Advocate (Criminal Side) appearing for the State submitted that the petitioner is abiding the condition from 13.02.2018 without any deviation. Further he added that the investigation is not yet completed.
4. Heard both sides. Documents perused. On 30.01.2018, at the time of passing orders in Crl.O.P.(MD)No.808 of 2018, this Court directed the petitioner to appear before the respondent police daily at 10.00 a.m. for a period of three weeks alone. Now, the learned counsel appearing for the petitioner submitted that the petitioner is ailing from heart disease. Hence, considering the submission made https://hcservices.ecourts.gov.in/hcservices/
by the learned counsel appearing for the petitioner as well as considering the nature of offence committed by the petitioner, this Court is inclined to modify the condition. Hence, the earlier condition imposed on the petitioner is modified to the extent that the petitioner shall appear before the respondent police daily at 10.00 a.m., for a period of two weeks.
5. Accordingly, this Criminal Miscellaneous Petition is ordered.
