O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to consider and dispose of the petitioner's representation dated 07.08.2023, conduct an appropriate enquiry and rectify the Patta in respect of the subject property in favour of the petitioner within a time frame to be fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The grievance of the petitioner is that the petitioner is the absolute owner of the property measuring an extent of 27.52 cents situated Page No. 2 of 6

at Ward No.2, Block 'B', Plot No.50, Old Survey No.511/1 (Part), now comprised in New Block No.53 and New Survey No.2209, Karaikudi Taluk, Sivagangai District. However, the Patta has been wrongly issued in the name of one Kottaiyur Nattar Receiver, S.R. Govindhaiyar.

4. The petitioner submitted a representation dated 07.08.2023 to the first respondent seeking rectification of the error and restoration of the Patta in the name of the petitioner. The first respondent, vide communication dated 26.09.2023, directed the second respondent to conduct an enquiry and submit a report. Thereafter, the second respondent, vide communication dated 17.10.2023, directed the third and fourth respondents to conduct an enquiry and submit a report.

5. However, till date, the petitioner has not been called for any enquiry and the error in the Patta has not been rectified. Hence, the petitioner has been constrained to file the present Writ Petition.

6. The learned Additional Government Pleader appearing for the first, second and fourth respondents, on instructions, would submit that the petitioner's representation dated 07.08.2023 would be considered and Page No. 3 of 6

appropriate orders would be passed by the second respondent within a period of sixteen weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 07.08.2023 and pass appropriate orders on its merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The second respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, the said Kottaiyur Nattar Receiver, S.R.Govindhaiyar and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
