ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 to 3 in Crime No.224 of 2015 on the file of the respondent police, A1 and A3 were surrendered on 28.05.2015 and A2 was arrested on 16.05.2015 respectively for the alleged offences punishable under Sections 294(b), 342, 302 and 506(ii) of I.P.C., and hence, seek bail.

2. According to the de-facto complainant, who is the father of the deceased, due to election dispute, the accused have attacked the deceased with knife and caused his death.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case. It is further submitted that even according to the prosecution, the first accused had attacked the deceased with knife, while the accused 2 and 3 caught hold of him.

4. The learned Government Advocate (Crl.side) submitted that the occurrence had taken place only on 06.05.2015 and the investigation is at initial stage. It is further submitted that the first accused had attacked the deceased with knife and the accused 2 and 3 caught hold of him.

5. Considering the overt act attributed against the accused, this Court is not inclined to grant bail to the first petitioner and hence, the https://hcservices.ecourts.gov.in/hcservices/

petition is dismissed as against the first accused and the petitioners 2 and 3 are released on bail with certain conditions. Accordingly, the petitioners 2 and 3 are ordered to be released on bail on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Sathankulam, Thoothukudi District and on further condition that the petitioners shall appear before the respondent police daily twice at 10.00 a.m. and 5.00 p.m. until further orders. sd/- 26/06/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
