The Commissioner, Watrap Panchayat Union, Watrap, Virudhunagar District.

... Respondent PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the order of the respondent in Na.Ka.No.A2/157/2012, dated 16.10.2012 and quash the same and consequently, direct the respondent to include the petitioner's name in roll of register of contractors of the respondent. For Petitioner : Mr.J.Anandkumar For Respondent : Mr. D.Sasikumar, Additional Government Pleader 1/4

ORDER

The Writ Petition has been filed challenging the order passed by the respondent herein, under which a composite order was passed de-registering the writ petitioner from the list of approved Contractors and also directing him to show cause as to why he should not be de-registered.

2. A perusal of the impugned order annexed reveals that on an earlier occasion, the writ petitioner has approached this Court challenging some of the actions of the respondent/Panchayat Union and the Panchayat Union had ultimately succeeded in the said Writ Petitions. 3.The respondent has stated in the impugned order that the petitioner had unnecessarily dragged the respondent Panchayat union to the High Court and had caused unnecessary expenses to the respondent Panchayat Union. Only on the said ground, the registration of the writ petitioner as a Contractor of the respondent Panchayat Union, has been cancelled. 4.Whenever, a citizen finds that he has got some grievance for the actions of the Panchayat, he is always at liberty to approach the High Court or any other 2/4

Court for redressal of his grievance. The said action of the petitioner cannot be put against him for de-registration and that passing of the impugned order by the respondent Panchayat is not legally sustained. Hence, the impugned order is set aside.

5.Accordingly, the Writ Petition is allowed. No costs. Consequently, connected Miscellaneous Petitions are also closed. 05.08.2022 Index :
