For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PRAYER :- To modify the condition imposed on the petitioner by this Hon`ble Court in Crl.O.P.(MD)No. 15678 of 2020 dated 23.12.2020 with a condition that the petitioner shall deposit a sum of Rs.50,00,000/- to the credit of Crime No.14 of 2020 before the learned Judicial Magistrate No.V, Tiruchirappalli. ORDER : The Court Made the following order :- This criminal miscellaneous petition is filed seeking modification of the conditions imposed by this Court in Crl.O.P.(MD) No.15678 of 2020, dated 23.12.2020.
2.The learned counsel for the petitioner submits that the petitioner was granted bail by directing him to deposit a sum of Rs.50 Lakhs to the credit of Crime No.14 of 2020 before the learned Judicial Magistrate No.V, Tiruchirappalli. Due to this onerous condition, the petitioner is not able to come out on bail. He further on instructions states that the petitioner will deposit the title deed equivalent to the tune of Rs.50 Lakhs. In this regard, he places reliance of the judgment of this Court reported in 2015

3.The learned Government Advocate (Crl. Side) appearing for the respondent vehemently opposed the petition for modification. He further states that 2450 persons were cheated to tune of more Rs.3 Crores by the petitioner. The mode of the petitioner is that he collects money from the depositors and after collection, he executes plot in favour of the depositors. From the year 2013, he has not even executed a one sale deed in favour of the depositors. 4.Per contra, the learned counsel for the petitioner submitted that the petitioner purchased plots but in view of the G.O., passed by the Government in the year 2017, he could not register the lay out and the same was approved by the Government in the year 2019 in TDCP No.104 of 2019.
5.Considering the fact that the petitioner's counsel on instructions that the petitioner will deposit the title deed equivalent to the tune of Rs.40 Lakhs, this Court is inclined to modify the condition imposed in Crl.O.P.(MD)No.15678 of 2020, dated 23.12.2020 is follows:- "The petitioner shall deposit the title deed to the tune of Rs.50 Lakhs to the credit of Crime No.14 of 2020 before the learned Judicial Magistrate No.V, Tiruchirappalli, within a period of 15 days from the date of receipt of a copy of this order."
6.The other conditions imposed by this Court shall stand confirmed.
