PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the 1st respondent to renew the petitioner's passport in passport No.N8137384 in reference to the File No.MD1075806250525 dated 22.10.2025 pending on the file of the 1st respondent Authorities.

ORDER

The present writ petition has been filed seeking a mandamus as against the first respondent to renew the passport of the petitioner based upon his application dated 22.10.2025.

2. A perusal of the records reveal that the petitioner has been implicated in a criminal case in Cr.No.164 of 2017 on the file of the of the Second respondent police under Section 107 of Cr.P.C. The settled position of law that after one year, the said proceedings pending before the Revenue Divisional Officer get lapsed.

3. In view of the above said facts, as on today, there is no criminal case is pending as against the writ petitioner and there is no legal impediment for the first respondent to consider the application of the petitioner for issuance of the passport.

4. In view of the above said facts, the first respondent is directed to consider the request of the petitioner and pass orders within a period of four weeks from the date of receipt of a copy of this order. 2/4

5. With the above said observations, this writ petition stands disposed of. No costs.
