ORDER

(Order of the Court was made by D. KRISHNAKUMAR, J.) The petitioner has filed the present Writ Petition for issuance of a Writ of Mandamus, to direct the second respondent to consider the petitioner's representation, dated 04.06.2013 and to take appropriate action in accordance with law.

2.The learned counsel appearing for the third respondent would submit that the third respondent has already submitted an application for revised planning approval and it is pending consideration before the authority concerned.

3.When the matter was taken up for hearing today, the learned Government Advocate appearing for the first respondent, on instructions, 2/5

would submit that no application for revised planning approval is pending before the second respondent and therefore, the petitioner's representation will be considered and necessary orders will be passed within a time frame. 4.In the light of the above, the respondents 1 and 2 are directed to consider the representation of the petitioner dated 04.06.2013 and pass appropriate orders, after providing due opportunity to the parties concerned. Such an exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. It is needless to say that if the third respondent approached the authority concerned for any revised plan approval or for relaxation, the same shall also be placed before the authority concerned.

5.With the above directions, the Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed. [D.K.K.,J.] [R.V.,J.] 24.01.2024 NCC : Yes / No Index : Yes / No ps 3/5
