O R D E R

This petition is filed to to withdraw the case in crime No.306 of 2013 from the file of the 2nd respondent and to transfer the same to the 3rd respondent for proper investigation in accordance with law.

2.None appears on behalf of the petitioner.

3.The learned Additional Public Prosecutor would submit that the investigation is almost over and the respondent police is yet to file the charge sheet and since, because of the pendency of this criminal original petition, they did not file any charge sheet.

4.Considering the said submission made by the learned Additional Public Prosecutor that since the entire investigation has already been completed, this Court is not inclined to transfer the investigation as prayed for and this petition is liable to be dismissed.

5.Accordingly, this criminal original petition is dismissed. However, the second respondent directed to file the final report, within a period of three months from the date of receipt of a copy of this order.
