ORDER : The Court Made the following order :- The petitioner, who is arrayed as Accused No.5, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(c) read with 20(b)(ii)(c) and 25 of NDPS Act in Crime No.63 of 2014 on the file of the respondent police and hence, seeks anticipatory bail.

2. According to the prosecution, the accused were found in possession of 102.5 kgs of Ganja.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and he has further submitted that co-accused were granted bail.

4. The learned Government Advocate (Criminal Side) appearing for the respondent submitted that the petitioner is having four previous cases of similar in nature and in all the cases, the quantity of the contraband are more than the commercial quantity. He has also further submitted that under Section 37 of the NDPS Act, the petitioner is not entitled for anticipatory bail.

5. Considering the bad antecedents of this petitioner and the quantity involved in this case, I am of the view that the petitioner is not entitled to grant anticipatory bail. Hence, this Criminal Original Petition is dismissed.
