ORDER : The Court Made the following order :- The petitioner is A2 apprehends arrest at the hands of the respondent police, in pursuance of the Non-Bailable Warrant issued on 17.07.
2013 by the learned Subordinate Judge, Paramakudi, in connection with a case in S.C.No.61 of 2013 for the alleged offences punishable under sections 147, 148, 341, 353 of IPC r/w. section 3 of TNPPDL Act, in Crime No.207 of 1997 on the file of the respondent police and hence, seeks anticipatory bail.
2.The learned counsel for the petitioner submitted that there are totally 12 accused in this case and 10 accused, who face the trial in S.C.No.20 of 2004 were acquitted by the trial court and the case was split up against the petitioner/A2 and one another accused in SC.No.61 of 2013 and the petitioner was not aware of the charge sheet filed in this case. The learned counsel further submitted that the petitioner undertakes to appear before the trial court for all future dates without fail.
3.The learned Government Advocate (Criminal side) appearing for the respondent submitted that the petitioner has been deliberately avoiding the receipt of the summon and therefore, he is not entitled for anticipatory bail.
4.However, considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

Magistrate, Mudukulathur and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the trial court in connection with a case in S.C.No.61 of 2013 for all future hearings without fail. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 26/06/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
