ORDER : The Court made the following order :- The petitioner / Accused who was arrested and remanded to judicial custody on 14.10.2025 for the offence punishable under Sections 5(n), 5(l) r/w 6(1) of POCSO Amendment Act 2019 and Sections 127(2), 351(2), of BNS Act, in Spl.S.C.No.125 of 2025 on the file of the Mahila Court, Pudukkottai in connection with the Crime No.22 of 2025 on the file of the respondent police, seeks bail,

2. The prosecution case is that the petitioner had already married and he had sexual intercourse with the victim girl, who is aged about 14 years. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks bail.

4. The learned Government Advocate (Criminal Side) submitted that the investigation has been completed and the charge sheet has also been filed. He further submitted that the petitioner has involved in very serious offence and the investigation is still pending. Hence, he strongly objected to the grant of bail to the petitioner.

Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence, the specific overt act against the petitioner, and also there are prima facie evidence available, hence interrogation is necessary, hence this Court is not inclined to grant bail to the petitioner at this stage.

6. Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 09.01.2026 msrm 3/5
