PETITIONER/ACCUSED No.27 Vs STATE REP.BY THE INSPECTOR OF POLICE CCIW CID POLICE STATION, RAMANATHAPURAM DISTRICT.

CR. NO.1/2015. ... RESPONDENT/COMPLAINANT For Petitioner : M/S.R.ALAGUMANI Advocate For Respondent : MRS.S.PRABHA, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who was working as a Village Administrate Officer between 2009-2010, has issued bogus certificate and with the aid of the certificate, other accused have caused loss to the Pookulam Primary Co-operative Society to the tune of Rs.35,78,305/-. The earlier applications of this petitioner in Crl.OP(MD)No.7926 of 2015 and Crl.OP (MD)No.9560 of 2015 were dismissed.

2. The learned counsel for the petitioner submitted that he is an innocent person and he has been falsely roped in this case, that the Revenue Divisional Officer found in the departmental proceedings that allegations against the petitioner are false and exonerated him and that the de-facto complainant did not give a complaint in person, which was sent by post to the District Crime Branch and on that basis, a case was registered.

3. In Crl.OP(MD)No.7926 of 2015, this Court has elaborately considered the counter affidavit filed by the respondent and the points argued in this petition and was not inclined to grant anticipatory bail and the same was dismissed. Further, it is specifically observed in the order that the custodial interrogation of the petitioner is necessary. https://hcservices.ecourts.gov.in/hcservices/
