Respondent PRAYER: This Criminal Original Petition has been filed under Section 482 of the Code of Criminal Procedure, praying to direct the learned Judicial Magistrate VI, Madurai, to receive the petitioner's petition dated 30.03.2015 and attest his affidavit and complete the proceedings within the period stipulated by this Court.

ORDER

This petition has been filed praying to direct the learned Judicial Magistrate No.VI, Madurai, to receive the petitioner's petition dated 30.03.2015 and attest his affidavit and complete the proceedings.

2. Heard both sides.

3. The petitioner is an Ex-service Man. He made a request to the authorities to make his wife as a co-pensioner. There is a spelling mistake in the name of the petitioner's wife. Therefore, the petitioner was advised by the Army Medical Corps Record Office to get an affidavit from the First Class Magistrate to that effect.

4. The learned counsel for the petitioner submitted that though a request has been made with the learned Judicial Magistrate No.6, Madurai, the learned Magistrate has not received the petitioner's petition and attest his affidavit and complete the process.

5. Considering the submission made, a direction is issued to the learned Judicial Magistrate No.6, Madurai, to receive the petition, peruse the same and do the needful, as sought for by the Army Medical Corps Record Office The said exercise shall be completed within a period of two weeks from the date of receipt of a copy of this order. Doing so, it is well open to the learned Judicial Magistrate, to satisfy himself about the record produced.

6. With the above direction, this Criminal Original Petition is disposed of.
