For Respondent : Mr.K.K.Ramakrishnan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in C.C.No.172/2016 on the file of the Judicial Magistrate Court, Paramakudi.

ORDER : The Court made the following order :- Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 2.The petitioner is an accused in C.C.No.172 of 2016, on the file of the learned Judicial Magistrate, Paramakudi, Ramanathapuram District. The case involves offences under Section 379 r/w 511 of IPC. The next hearing date is on 20.03.2020.

3.The learned counsel for the petitioner states that he will appear before the Court below on the said date and apply for recall of warrant and he will give a specific undertaking that he will not abscond in this case every hereafter, he will scrupulously attend all the hearing dates in future. On account of his absence, the progress of trial will not be affected. If this undertaking is breached, the order now passed will stand vacated automatically and the petitioner will be remanded to custody.

CRL OP(MD). No.598 of 2020 4.Recording the said undertaking given by the petitioner through his counsel, the petitioner is directed to appear before the Court below on 20.03.2020 and apply for recall of warrant. On such application is being filed, the Court below shall recall the warrant at the end of the day. The Non-Bailable Warrant issued against the petitioner will be kept in abeyance till then. 5.The Criminal Original petition stands disposed of, on these terms.
