ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 379 of IPC and r/w Section 4(1)(1A), 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.280 of 2021, seek anticipatory bail.
2.The case of the prosecution is that the accused persons have illegally transported the river sand without valid permission. Hence, the complaint.
3.The learned counsel for the petitioners would submit that the petitioners are innocent persons and they are not having any previous case to their credit.
4.The learned Government Advocate(Crl.side) appearing for the respondent police submitted that the second petitioner has already been arrested. The first petitioner is having twelve previous cases https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.870 of 2022 to his credit.
5.This is a second anticipatory bail application. Considering the fact that the second petitioner has already been arrested, the petition as against him is dismissed. Further, considering the antecedents of the first petitioner, this Court is not inclined to grant anticipatory bail to him. Accordingly, this Criminal Original Petition is dismissed.
